Laws For Maternity Leave
There are certain laws concerning maternity leave and benefits. These laws are structured and formed in order to protect and safe guard pregnant women and to ensure that they are denied with any of the statutory rights. Maternity and pregnant rights are formed and governed by Family and Medical Leave Act. Suggestions are extended to the pregnant women to be familiar with all the laws and rules relating to maternity leave and benefits.
Employers employing more than 50 employees are bound to obey the rules and regulations of the Family and Medical Leave Act passed by the government. Small concerns employing less than 50 employees do not come under these rules and are not liable for pay compensation or maternity allowance.
The employees working larger establishments must have been the employee of the company for a minimum period of 12 months. Pregnant women must have worked under the employer for 1250 hours during the 12 months tenure.
In case of persisting morning sickness the employee may be relieved from full time work. This is called reduced leave. Intermittent leave is also sanctioned in between in case of continuous sickness. Medical report from the doctors is essential to avail these benefits.
Position of work may be changed if the women employed feels inconvenient to carry out her work during the maternity days. Leave during the maternity days are allowed mainly to protect and safe guard the health of the baby and the recovery of the mother. The Family and Medical Leave Act allow a period of 12 week leave for normal and uncomplicated deliveries.
Employee should be reinstated with the same job and position on return after the lapse of maternity leave. Laws governing maternity leave are not universal and vary from company. Small companies do not come under any of the maternity leave of pay structure.
If the employee is unable to get back to work after the completion of the leave she is at liberty to discuss the circumstances with the employer and get the favor of relaxing and flexible work schedule. Part time working facility may be granted if necessary.
